What is a Building Handover Certificate?

A Building Handover Certificate is an official document issued by the builder or developer when the construction is complete, and the flat or villa is ready for possession. It legally transfers the property from the builder to the buyer.

Find homes with 100% verified handover and completion certificates – start your property search with peace of mind!

Key Features of a Handover Certificate:

  • Confirms the date of handover
  • States the property details (flat number, block, floor)
  • Lists all amenities, fittings, and fixtures
  • Confirms completion of basic facilities (electricity, water, sewage)
  • Signed by both builder and buyer

Note: The handover certificate is not a legal substitute for the completion certificate (CC) issued by the government.

What is a Completion Certificate (CC)?

A Completion Certificate is a document issued by the local municipal authority (such as CMDA, BDA, HMDA, GHMC, or Corporation office) after verifying that the construction is:

  • Done as per the approved building plan
  • Followed zoning laws, building bye-laws, and safety norms
  • Passed fire, sewage, and structural safety checks

Documents Needed to Apply for CC:

  • Approved building plan
  • Architect’s completion report
  • Site photographs
  • Fire NOC
  • Pollution control NOC
  • Structural stability certificate
  • Lift safety certificate (for buildings with lifts)

Difference Between Handover Certificate and Completion Certificate

What is an Occupancy Certificate (OC)?

Once the Completion Certificate (CC) is obtained, the builder must apply for an Occupancy Certificate (OC). This confirms that:

  • The building is safe for people to live in
  • It complies with health and safety guidelines
  • Proper access to water, sewage, and roads is available

You cannot legally move into a building without an OC.

Why Are These Certificates So Important?

Without proper certificates:

  • Your property might be considered illegal
  • Bank loans may be denied
  • You may not be able to register the property
  • Water, electricity, and drainage connections may be blocked
  • You may face penalties from authorities
  • Selling the property in future may be legally difficult

Checklist Before Accepting Handover from Builder

Before accepting the property, verify:

✔️ Final payment clearance

✔️ Handover certificate (with detailed list of fittings and services)

✔️ Basic facilities working – electricity, water, lift

✔️ Quality check – tiles, doors, walls, plumbing

✔️ Completion certificate from the local body

✔️ Fire safety systems installed and working

✔️ Parking space as promised in agreement

✔️ Copies of NOC – fire, sanitation, and pollution

RERA Guidelines on Handover and Completion

As per RERA Act (Real Estate Regulation and Development Act):

  • Builders must deliver possession on time
  • Handover should only be given after CC is issued
  • Buyers can file a complaint on the RERA portal for delay
  • Full project details must be uploaded and updated regularly

This law protects homebuyers and ensures transparency.

Steps to Apply for a Completion Certificate

If you're a builder or association:

  1. Collect necessary documents
  2. Submit online/offline application to the municipal body
  3. Inspection by government officials
  4. Corrections (if required)
  5. Get Completion Certificate issued

Timeframe:

  • Usually 15–30 days depending on the authority and project

What to Do If the Builder Fails to Provide a Completion Certificate?

  • Don’t take possession until CC is issued
  • File a complaint on the state RERA website
  • Approach a consumer court if builder delays
  • Get the support of the Apartment Association or Legal Advisor
  • Keep all written communication, agreements, and receipts as proof

FAQs – Building Handover and Completion Certificate in India

1. Can I live in a flat without a completion certificate?

No. It’s illegal to occupy a flat without CC. Your utilities might be disconnected, and you can face penalties.

It is issued by the local municipal authority or the development authority in your city.

3. What if the builder refuses to give the handover certificate?

You can approach RERA or the Consumer Forum and claim possession legally.
