  • Hindu Law: Property is divided among close family members such as the spouse, children, and mother. If no close family members are left, the property goes to distant relatives like grandparents, siblings, or grandchildren. The rules for agricultural land may differ from state to state.
  • Muslim Law: Property is divided according to specific shares. Sons typically get a larger share than daughters, but daughters still have a legal right to inheritance. Some properties may be managed by religious trusts.
  • Christian and Parsi Law: Property is divided equally between the spouse and children. If there are no direct family members, the property goes to distant relatives or the government.

2. Testamentary Succession (With a Will)

When a person leaves behind a will, they specify who will inherit their property. The will simplifies the inheritance process and helps reduce the chances of disputes, as it is clear who gets what.

Clear Steps in the Property Inheritance Process

1. Obtain a Death Certificate

The first step is to get the death certificate from the local government office. This is needed for all further processes and should be obtained within 21 days of the death.

2. Get a Legal Heir Certificate

The family members need to apply for a legal heir certificate from the local revenue office. This certificate confirms who the rightful heirs are. To get it, you will need documents like ID proof, ration card, and the death certificate. This document is crucial for claiming assets like bank accounts, insurance, and pension benefits.

3. Obtain a Succession Certificate

If the person left behind movable property like bank accounts, fixed deposits, or shares, a succession certificate from the court is required to claim and manage these assets.

4. Update Property Records – Mutation

To update the ownership of property (land or building), the local revenue office must be informed. This is called "mutation." Documents required include the death certificate, legal heir certificate, and property papers. Mutation is mandatory before selling or constructing anything on the inherited land.

5. Pay Registration Fees and Stamp Duty

When transferring property through a will, registration fees and stamp duties may apply. These charges differ from one location to another. You can get information about fees from the sub-registrar’s office.

Taxes on Inherited Property

  • No Inheritance Tax: In India, there is no inheritance tax. This means that you don’t have to pay any tax when you inherit property.
  • Capital Gains Tax: If you sell the inherited property, you may have to pay capital gains tax on the profit. Long-term capital gains are taxed at 20%, while short-term gains depend on the income level.
  • Tax on Rental Income: If you rent out the inherited property, the rental income is taxable, and you need to pay tax based on the income earned.
